The following sets out the terms of use of the Hostmore plc website.

1.    Important Notice

1.1    These terms apply to your interaction with Hostmore plc (“Hostmore”) either (i) directly via our website namely: www.hostmoregroup.com (the “Website”); or (ii) via a third party.  Our Website gives you the chance to register for the latest news from Hostmore. 
1.2    These terms should be read in conjunction with the
Privacy Notice and Cookies Policy for the Website which tells you how we collect and use personal data you provide to us or which we collect.
1.3    By accessing or using the Website and/or registering with us you confirm that you accept these terms, our
Privacy Notice and Cookies Policy in their entirety each time you access the Website. If you do not agree to these terms and/or the Privacy Notice and/or Cookies Policy, please do not use the Website.

2.1    The Website is owned and operated by Hostmore plc (“we”, “us”, “our” “Hostmore”).
2.2    We are registered in England and Wales under company number 06034603 and our registered office is at Highdown House, Yeoman Way, Worthing, West Sussex, United Kingdom, BN99 3HH.
2.3    The VAT number of the group of which Hostmore forms part is 203 4537 42.


3.    Use of the Website


3.1    The Website is designed purely to provide information on Hostmore and does not constitute an offer to buy or sell securities in the company, nor does it constitute investment advice.
3.2    You may use the Website for lawful purposes only. You must not use the Website in any way that breaches any applicable local, national or international law or regulation or which is in any way unlawful or fraudulent.
3.3    You are allowed to access, download and print the materials on the Website for your own personal, non-commercial use only provided you keep intact any copyright or property names.
3.4    You must not:
(a)    copy (including storing and downloading), distribute, publish, alter, adapt, create derivative works from, or otherwise use the material on the Website, either in whole or in part except as expressly permitted above;

6.1    The Hostmore logo is a registered trademark. Certain names, words, titles, phrases, logos, icons, graphics or designs to the pages of the Website may constitute trade names or unregistered trademarks owned by members of Hostmore. The display of any of the above trade names or trademarks on pages of the Website does not imply that any licence has been granted to any third party in respect of the same.  All other product or company names and devices, logos, icons, graphics or designs referred to on the pages of the Website are the trademarks of their respective owners and are exhibited only in such a manner as is intended to be for the benefit of such trademark owners and we intend no infringement of such trademarks.  


7.    Availability of the Website


7.1    We reserve the right to suspend access to all or part of the Website or close it indefinitely without notice. Access may be terminated or suspended either in relation to specific users or to all users.
7.2    To the extent permitted by law we accept no liability if the Website becomes either temporarily or permanently unavailable.
7.3    In addition, we do not warrant that the functions or materials on or accessed from, the Website shall be uninterrupted or free from errors.

8.1    We reserve the right to change or update our terms and conditions, and/or any part thereof at any time at any time without notice.

9.    Ownership


9.1    We are the owner or licensee of all intellectual property rights in the Website and in the materials and content which appear on the Website. This includes but is not limited to the text, photographs, images, graphics, illustrations, designs, written and other material including the program and code. Our rights include trademarks, copyright, design rights and all other intellectual property rights and all our rights are reserved.  
9.2    If you acquire any rights in or to the Website or materials on it, you agree to assign those rights, on a worldwide basis, to us and unconditionally and irrevocably to waive all moral rights you may have acquired.


10.    Viruses and hacking


10.1    We do not warrant that the Website, its content or the server(s) that make it available are error or virus free or free of other harmful components or that your use of the Website will be uninterrupted. You are accessing the Website at your own risk and to the extent permitted by law and, subject to clause 14.7, we will not be liable for any loss or damage suffered by you as a result of viruses or other harmful material which you access from the Website or may arise to computer equipment as a result of using the Website.
10.2    You are solely responsible for ensuring that you have suitable equipment and security and virus protection in place before using the Website.

10.4    You must not introduce viruses, trojan horses, worms, logic bombs, spyware, adware or other harmful materials to the Website which may adversely affect the operation of any computer or program or the Website.

11.1    The Website may contain links to websites operated by third parties. We have not reviewed or endorsed and do not review or endorse such websites and are not responsible for the content of nor accept any liability howsoever arising in respect of any of such websites.
11.2    The presence of links to third party websites is not intended to and shall not constitute a recommendation by us of such websites nor of any advice or information posted on them.
11.3    Your access of such third party websites remains solely your responsibility and is at your own risk.
11.4    If you wish to provide a hypertext or other link to or from the Website, you will first need to obtain our written consent. We have sole discretion to permit or reject any such requests and if we permit any such request we shall be entitled to impose any conditions that we consider in our sole discretion to be necessary. 11.5    Where we have granted consent pursuant to clause 11.4 above, we expressly reserve the right to withdraw our consent at any time to any link which in our sole opinion is inappropriate.

12.1    There are parts of the Website which can only be accessed by users who have registered with us and who therefore have a user name and password (“login details”). Please see the registration section of these terms concerning passwords.

13.    Feeds

13.1    We may provide information on the Website via RSS Feeds and RNS Feeds. We may also provide users the opportunity to register to receive RNS Feeds directly by email. The information contained in RSS Feeds and RNS Feeds (whether on the Website or directly by email) is provided solely for the convenience of users and we are not responsible for its content.

14.    Our liability

14.1    The information contained on the Website is not comprehensive and whilst we take all reasonable care to ensure that the information on the Website is accurate and up to date, the information has not been independently verified, and no representation or warranty, expressed or implied, is made as to its accuracy or completeness.  You should recognise that information contained on the Website may become out of date over time.
14.2    In no event will Hostmore, nor any of its subsidiaries or its or their directors or officers, or any other person, accept any liability for any loss howsoever caused arising directly or indirectly from the use or inability to use the Website or the information thereon even if Hostmore has been advised of such damages and any such liability is hereby excluded. As some jurisdictions prohibit the exclusion or limitation of liability or consequential or incidental damages, the above limitation may not apply to you.
14.3    Any financial reports contained on the Website are only current as of the respective date contained in the particular report. Hostmore makes no commitment and disclaims any duty to update or correct or to provide notice as to any error or omission in any report or other information contained on the Website. 
14.4    The value of shares (and income from them) can go down as well as up, and you may not get back the full amount you originally invested. If you need advice, please consult with a professional qualified financial advisor.  
14.5    We shall not be responsible for any breach of these terms and conditions caused by circumstances beyond our reasonable control.
14.6    To the extent we may lawfully do so we exclude liability for any implied terms and conditions including those implied by statute, common law or the law of equity.
14.7    Nothing in these terms shall affect our liability for death or personal injury caused by our negligence, nor our liability for fraud or serious misrepresentation, nor any other liability which cannot be excluded or limited under applicable law.
14.8    If you are a consumer, nothing in these terms affect your legal rights as a consumer. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

16.    Registration


16.1    We have sole discretion to determine whether or not to allow you to register with us or access any sections of the Website which require login details and we may suspend such access at any time.
16.2    If we do provide you with login details, it is your responsibility to ensure that these details are kept confidential at all times and you must not disclose your login details to any third party.
16.3    In the event that a third party gains access to your login details, you should notify us immediately by emailing
enquiries@hostmoregroup.com.  We are not liable for any loss resulting from your failure to protect the confidentiality of your login details.
16.4    We reserve the right to disable any login details at any time if in our opinion there is a risk of the confidentiality of the login details being compromised.
16.5    Registered users are required to submit valid email addresses and personal information. This is for fraud prevention reasons and the data is kept securely in accordance with Hostmore’s
Privacy Notice.
16.6    Any abuse may result in your registration being suspended, disabled or terminated. Abuse includes, without limitation, any fraudulent activity. Fraud is a crime.

18.    Laws

18.1    If any of the terms or conditions is or becomes invalid or contravenes any law then the remaining provisions shall not be affected.
18.2    The Website, any content on the Website and these terms are governed by English law. You and we both agree to submit to the exclusive jurisdiction of the English courts. 
18.3    No waiver shall constitute a waiver of any other terms.  No failure by us to exercise a remedy shall constitute a waiver to subsequently exercise any remedy.
